Training Contracts and Forms

Variation of training contracts

To vary a training contract, an Application to Vary the Training Contract Form must be completed by the employer and apprentice and submitted to an Australian Apprenticeship Support Network Provider.
 
Circumstances where a variation to a training contract is necessary may include:
  • change of qualification/qualifications stream
  • change of date of commencement of the training contract
  • extension of the completion date
  • change of RTO
  • change of attendance type (e.g. school-based part-time to full-time)
  • change of apprentice name.

Suspension of training contracts

To suspend an apprenticeship training contract for a fixed period of time, an Application for Approval to Suspend a Training Contract Form must be completed by the employer and apprentice and submitted to an Australian Apprenticeship Support Network Provider.
 
Circumstances where a suspension to a training contract may be sought include a shortage of work (in this circumstance, suspension may be granted for three-monthly periods).
 
Other reasons where suspension may be approved for up to 12 months may include:
  • illness
  • travel overseas
  • injury related or unrelated to work
  • maternity leave
  • other reasons.

Cancellation of apprenticeship training contracts

An apprenticeship training contract has a probationary period (usually three months) and can be cancelled by either an apprentice or an employer during this period.

Please note that the VRQA regulates the apprenticeship training contract, not the apprenticeship employment contract. The mutual consent requirement, described below, only applies to the apprenticeship training contract.  That means that the VRQA has no power or authority to investigate or intervene when an employer decides to cease employing an apprentice or trainee.

After the probationary period has expired an apprenticeship training contract can only be cancelled when both the employer and apprentice agree. To mutually cancel a training contract both the employer and the apprentice must complete the appropriate form and submit them together to an Australian Apprenticeship Support Network Provider.

  • Request to Cancel the Training Contract Form - employer form
  • Request to Cancel the Training Contract Form - apprentice form.

Cancellation of traineeship training contracts

Mutual consent is not required to cancel a traineeship training contract. Either party can do it. Just submit the Request to Cancel a Training Contract - trainee form to your Australian Apprenticeship Support Network Provider.
